Terms of Service
Horni.io welcomes you. Horni.io provides its products and accompanying online services (combined referred to as “the Work”) subject to the following Terms of Service (“TOS”) which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time at https://horni.io/tos.php. By accessing and using the products and services, you accept and agree to be bound by the terms and provisions of the TOS.
Age Restriction. The user certifies that they are at least 18 years of age and understand they will see adult content.
User Generated Content. You may create, share, view, and download certain content via the online services. This material will be governed by the User Generated Content License found at https://horni.io/ugcLicense.php and the Community Content Policy found at https://horni.io/contentPolicy.php. You accept and agree to be bound by the terms and provisions of these licenses and policies.
E-mail. You consent to us contacting you via e-mail. Some situations in which you may receive e-mail from us include: purchase receipts, game update news if you have opted in to receive development updates, receiving updates on bug reports you have filed, notifications of replies to your posts, etc. You give affirmative consent to receive these emails which may or may not contain sexually oriented messages. We will not share your e-mail with third parties.
Limitation on Liability. HORNI.IO OFFERS THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO YOU.
EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some of the Work is available on mobile devices. Do not use the Work in a way that distracts you and prevents you from obeying traffic or safety laws.
Governing Law. This agreement is governed by the laws in force in the jurisdictions in which we directly operate, and not the jurisdictions from which this site may simply be accessed, or in which you reside. You agree to submit to the exclusive jurisdiction of those relevant courts we deem appropriate to resolve any particular dispute or legal issue, at our sole discretion.
Analytics. We may collect and use analytic data on your usage, including the use of the Google Analytics platform. This platform may place a “cookie” on your browser, which can be read by Google. You can learn more, including how to opt-out of analytics, by visiting Google's Privacy Page.
Privacy. We do not sell personal information to any party. To protect the safety of our users, we use certain third party utilities, such as Google Recaptcha and a VPN checker that may disclose a user's IP address when taking certain actions on this website (this makes it harder for spammers to attack the website.)
Arbitration. Any controversy or claim arising out of or in connection with this agreement may, at our discretion, be settled by binding arbitration of a professional third-party arbitrator chosen by us. You agree to be bound by the decisions of the chosen arbitrator in that case.
Termination. Access to the work may be terminated at any time by us without notice. Our limitation on liability and rights granted to us as described in this agreement will nevertheless survive any such termination.
Severability. If a provision of this Agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect:
- The validity or enforceability in that jurisdiction of any other provision of this Agreement; or
- The validity or enforceability in other jurisdictions of that or any other provision of this Agreement.
Updates. Horni.io may update these terms in the future at its discretion without notice.
